One thing that no one wants to experience is having to take legal action, it can become significantly more stressful if you’re having to take legal action against your own employer. Unfortunately, the cold hard truth is the fact that something like this is very common. Every day people are contemplating taking legal action against their employer for their actions.
Unfortunately, some employers think they’re too powerful and can do whatever they want. This has not only been linked to the Great Resignation, but this state of mind is still very prevalent for many businesses. So, when is it time to get help and seek legal action against your employer? Well, here are several things you’re going to want to keep in mind!
Unpaid Wages and Overtime
The largest reason why employees need to take action against their employer is wage theft. A lot of employers are trying to figure out ways to pay less than minimum wage, which is already a major issue, but other reasons can include making unreasonable deductions from pay and not paying for overtime. Unfortunately, it’s something that happens all the time. If this is happening to you, you’re going to need to take action immediately.
Withholding Money
You are able to take legal action against your employer if they refuse to pay you what they owe you. This can include a variety such as unused holiday pay, maternity leave, sick leave, final paycheck, and a bonus, but it can go beyond this too. Some employers will try to “punish” their employees by doing, and it’s not acceptable! Make sure to put them in their place and take legal action!
Wrongful Termination
This can go hand-in-hand with discrimination, and it also falls under wrongful termination. For starters, you’ll need to be in a protected class or have sufficient evidence you were wrongfully terminated based on sexual harassment or whistleblowing. Unfortunately, if you’re sick and it’s not a disability, then it’s not a part of the protected class.

Discrimination is illegal, and unfortunately, many employers still believe they can get by with that. If you are being mistreated, which includes not getting a promotion or losing your job due to your race, color, religion, sex, national origin, age, disability, or genetic information, then it may be time to take action. The list of protected classes is growing, and depending on which state you are in, the list is bigger. If you believe this has happened and you have sufficient evidence, then take action.

There could be a variety of reasons for a class action lawsuit to occur.
